Terms of Use for the mymirah App

1. Provider and scope

The mymirah app for Android and iOS is offered by:

Sigfried Payam Ewert
Sole proprietor – mymirah
Maienweg 105
22297 Hamburg
Germany

Email: support@mymirah.app

These terms govern use of the app. They do not govern visits to the website. The website has no purchases and no payments.

Download is intended through the Apple App Store or Google Play. Whether the app is available there follows from the store. These terms state no release date. The store’s terms also apply to download, the store account, and payment. They do not replace rights you have under the law or under the store’s terms. Apple and Google are not responsible for every contractual claim merely because download or payment goes through the store.

Licensing of the iOS app follows Apple’s standard EULA. Mandatory statutory rights remain unaffected.

2. The service

mymirah keeps cycle, bleeding, symptoms, notes, and further entries in an encrypted database on your device. The app shows overviews and estimates and gives religious orientation from the stored rules of the school of law you choose. It also offers prayer times, local reminders, and optional password-encrypted backups. There is no user account and no synchronization between devices.

Without a subscription:

  • journal, cycle, bleeding, and notes,
  • the cycle view on the home screen,
  • prayer times as clock times,
  • unchanged catalogue reminders,
  • encrypted backup and restore.

Premium also includes, including during access without a store charge:

  • personalized information on hayd, istihada, tuhr, and nifas,
  • the fiqh card on the home screen,
  • fiqh displays in the calendar,
  • analysis charts,
  • your own reminders and editing reminder texts.

Cycle and fertility information are estimates and are not for contraception. Religious guidance is not a binding ruling. The app does not provide a diagnosis.

3. The contract

The agreement on use is formed when you accept these terms during setup. A subscription is formed when you complete the purchase in the Apple App Store or on Google Play. The store shows the price, currency, billing period, and tax information beforehand.

The store handles payment and the store account. We remain responsible for the app and for providing it in conformity with the contract, where duties apply to us.

In Germany, Apple Distribution International Ltd. acts in its own name for our account when you purchase. The licence to use the iOS app is between you and us. On Google Play, Google’s role follows the Google Play terms. Our responsibility for the app remains.

We set no minimum age of our own. Capacity to contract and the store’s age conditions apply. Accepting the contract is not consent to the processing of personal data.

4. Free use

You use the free version without payment.

The app can also grant 14 days of Premium on the device, without a store subscription and without a charge. That is not a store trial. Access starts with the first use on the device, ends by itself, and does not become a paid subscription. A further period after reinstallation, restore, or a change of device is not owed.

5. Subscriptions

Premium is available as a monthly or annual subscription. The store shows the price, currency, period, and tax information before purchase. They can differ by country or region.

A free trial exists only if the store shows it to you as eligible before purchase, including its length and the price afterwards. These terms do not promise a trial. The 14 days without a charge and a trial shown by the store are not added together.

6. Renewal, cancellation, and end

Subscriptions renew until you cancel them in the store. Statutory cancellation rights and rights granted by the store remain.

  • Apple: Settings → your name → Subscriptions. Under the Apple Media Services terms published for Germany, you can also cancel with immediate effect and request a pro-rata refund. For that, contact Apple Support.
  • Google Play: subscriptions in the Google account. For subscriptions in Germany with a billing period of more than one month that began on or after 1 March 2022, Google describes cancellation with immediate effect and a pro-rata refund after the first period, where that option is offered.

Deleting the app, the local data, or the cloud backup does not cancel the subscription. Restore asks the same store account for existing purchases. The app does not cancel anything and does not open subscription management. Moving a subscription between Apple and Google is not provided.

When Premium ends, your entries and ordinary recording remain. Premium evaluations are visible again when Premium is active. Changed reminders stay stored, and their delivery is paused. Unchanged catalogue reminders, and backup and restore, remain available.

7. Use

You receive a simple, non-transferable right to use the app for personal, non-commercial purposes on devices you own or control, within the store rules.

You may not modify, decompile, or reverse engineer the app except where the law allows it. Articles, texts, and stored rules are protected. Included open-source components are covered by their own licences.

The app calculates prayer times on the device after a place has been saved. When you search for a place, the app sends the place name you submit to Open-Meteo. If you have the location determined once, the app sends the coordinates to Nominatim and then to Open-Meteo. Details are in the app privacy notice.

8. Medical and religious limits

The app does not provide a diagnosis or a binding religious ruling. Forecasts and classifications can be incomplete or inaccurate. They do not replace medical advice or an individual religious assessment. These statements do not limit liability under section 11.

9. Data and backups

The app stores entries on the device. You can optionally store password-encrypted backups in Google Drive, in iCloud Drive, or as a file. Details are in the app privacy notice. Accepting these terms is not consent to the processing of personal data.

Your entries remain yours. We cannot restore a forgotten backup password. Deleting the local data does not remove cloud backups, files you saved yourself, or system backups. We have no access to those copies.

10. Changes

We provide updates that are required for the app to remain in conformity with the contract, including security updates, for the period provided by law. We do not guarantee the availability of the stores, Google Drive, or iCloud Drive.

We change paid functions, beyond what is required to maintain conformity, only within the statutory limits. If such a change impairs use more than only insignificantly, you may end the contract free of charge under the statutory conditions.

We agree changes to these terms with you, unless the law already allows a change without a separate agreement. Continued use alone is not acceptance.

11. Statutory rights and liability

The statutory rights for defects in digital products apply. Our liability follows the statutory rules. A refund through the store is not withdrawal. Cancellation, withdrawal, a store refund, and ending the contract for defects are distinct from one another.

Instructions on withdrawal

These instructions apply to consumer contracts with Sigfried Payam Ewert to which the German statutory withdrawal rules apply.

They do not apply to a purchase that a store company concludes with you in its own name. In Germany, Apple Distribution International Ltd. concludes the purchase in its own name. Apple’s withdrawal information applies to that purchase. If the contract is concluded with us, these instructions apply. If Google or another store company concludes the purchase in its own name, that company’s information applies. A refund procedure of the store does not replace withdrawal towards the company with which you concluded the contract.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded. This applies to a service contract and to a contract for digital content not supplied on a tangible medium. The period does not begin before we have informed you of the right of withdrawal in accordance with Article 246a § 1(2), first sentence, no. 1 of the Introductory Act to the German Civil Code (EGBGB).

To exercise the right of withdrawal, you must inform us (Sigfried Payam Ewert, Maienweg 105, 22297 Hamburg, Germany, email: support@mymirah.app) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract. That amount requires a contract that provides for payment of a price for the service, your express request that performance begin before the end of the withdrawal period, and our proper information under Article 246a § 1(2), first sentence, nos. 1 and 3 EGBGB. If the contract was concluded off-premises, that request must have been provided on a durable medium. If the agreed total price is disproportionately high, the amount is calculated on the basis of the market value of what has been provided. For digital content not supplied on a tangible medium, you owe no compensation for value.

For a digital product, you must also not continue to use it or make it available to third parties after withdrawal. We may prevent further use. We may not continue to use content other than personal data that you provided or created while using the product, except where § 327p(2) of the German Civil Code (BGB) applies. On request, that content is to be made available to you under the conditions of § 327p(3) BGB.

Early expiry

The right of withdrawal does not expire merely because the app is started, Premium is activated, or these terms are accepted.

For a service contract, it expires, where no price is payable, when the service has been fully performed. Where a price is payable, it expires on full performance only if, before performance began, you expressly agreed that we would start before the end of the withdrawal period and you confirmed your knowledge that the right of withdrawal expires when performance is complete.

For a contract for digital content not supplied on a tangible medium, it expires, where no price is payable, when we have begun performance. Where a price is payable, it expires only if we have begun performance, you expressly agreed that we would start before the end of the withdrawal period, you confirmed your knowledge that your right of withdrawal expires when performance begins, and we have provided you with confirmation under § 312f BGB.
